Cohabitation Agreements

Cohabitation Agreements

Despite a sharp increase in the number of cohabiting couples in recent years there is no status in English Law as a common law spouse or partner despite what many believe.

For cohabiting couples who want legal protection we can draft for you a Cohabitation Agreement.

This can set out who owns what and in what proportion and document how you will split your property, it’s contents, personal belongings, savings and other assets should the relationship breakdown.

The Agreement can also set out how you and your partner will manage your day to day finances while you live together.

Prenup Agreements

Pre-Nuptial Agreements

A Prenuptial Agreement is a contract that is entered into by a couple freely and voluntarily before a marriage or civil partnership.  It is a formal written agreement that sets out the terms governing what will happen to each party’s property and assets if the marriage were to come to an end.

Whilst not binding under English Law, Judges are attaching more weight to them and are more likely to uphold them if it’s contents are reasonable, not out of date (preferably including a provision for a review after a period of time) and if it was properly drafted with full disclosure and each party received independent legal advice.
