A Prenuptial Agreement is a contract that is entered into by a couple freely and voluntarily before a marriage or civil partnership.  It is a formal written agreement that sets out the terms governing what will happen to each party’s property and assets if the marriage were to come to an end.


Whilst not binding under English Law, Judges are attaching more weight to them and are more likely to uphold them if it’s contents are reasonable, not out of date (preferably including a provision for a review after a period of time) and if it was properly drafted with full disclosure and each party received independent legal advice.
