Probate Fees

Probate: Range of Costs

Fixed Fee - £400.00 + VAT

Kieran Clarke Green offers a fixed fee package for obtaining the Grant of Probate on your behalf.

As part of our fixed fee our dedicated and experienced probate solicitor will:

  • Meet with the Executor(s) or Administrator(s) in order to ascertain the details of the estate and accurately identify the type of probate application you will require
  • Draft a legal Oath and the relevant HMRC forms
  • Meet with you again to go through the forms and arrange for a Commissioner/Solicitor to witness you swearing the Oath
  • Make the application to the Probate Court on your behalf
  • Obtain the Grant of Probate and securely send sealed copies to you or arrange for your collection from the office

 In addition there will be the following fees to pay:-

  • Commissioner’s fees of £7.00 per Executor or £5.00 per Administrator
  • H M Court Services – Probate fee £155.00 plus 50p per sealed copy of the Grant  

  (1 copy per asset usually)

As this fixed fee package does not include us collecting in any assets of the estate, the Executors/Administrators will be responsible for our costs and expenses. An invoice will be sent to you upon us obtaining the Grant of Probate.

On average, this process is completed within 4-6 weeks as it will usually take 2 to 3 weeks to receive the Grant of Probate once we have submitted the application to the Probate Registry. 

Please note, this fixed fee package only applies to estates in which there is no inheritance tax payable and the Executors do not need to submit a full account to HMRC. 

Applying for the Grant, collecting and distributing the assets

Our fees are charged on an hourly basis (at £217.00 per hour) and will typically range from £1,000 to £4,000 plus VAT depending upon the individual circumstances of the matter. 

For example, if there is one beneficiary and no property, costs will be at the lower end of the range.  If there are multiple beneficiaries; inheritance tax to pay; a property; multiple bank accounts or shareholding; costs will be at the higher end.

We will handle the full process for you.  This will include the following principal exercises:-

  • If instructed, carry out a search on Certainty, the National Will Register, to reduce the risk of distributing on an estate on an assumed intestacy basis or when a will or later will may exist.
  • compiling details of all assets owned at death and obtaining any necessary valuations;
  • compiling details of  any liabilities due at death and of any funeral expenses;
  • assessing whether any inheritance tax is payable and dealing with the HM Revenue & Customs before the Grant of Probate/Letters of Administration can be obtained;
  • preparing the legal Oath and any necessary H M Revenue and Customs account in support of an application for the grant;
  • on receipt of the grant, collecting in all assets and settling any liabilities;
  • assessing whether any income tax is outstanding or due for repayment, preparing any necessary returns or claims and dealing with H M Revenue & Customs;
  • distributing the estate in accordance with the terms of the Will or in the absence of a Will, the rules of intestacy

In addition, there are a number of expenses (called disbursements) which may have to be paid to third parties to enable us to complete the administration of the estate. These may include the following:-

-        Certainty Will Search -  £95.00 + VAT

-        Commissioner’s fees of £7.00 per Executor or £5.00 per Administrator

-        H M Court Services – Probate fee £155.00 plus 50p per sealed copy of the Grant          (1 copy per asset usually)

-        In the region of £71.00 + VAT s.27 Notice in the London Gazette and £92.00 + VAT s.27 Notice in a Local Newspaper.  This helps to protect Executors/Administrators against unexpected claims.

On average, the administration of an estate can take approximately 6-9 months to conclude.  However, this estimate may change, depending on how your specific case progresses.
